FIBER OPTIC DESIGNS WINS PATENT INFRINGEMENT CASE AGAINST CHINESE MANUFACTURER, BORTEX

YARDLEY, PA – The U.S. District Court for the Eastern District of Pennsylvania, with Judge Mitchell S. Goldberg presiding, ruled on December 2, 2013 that Fiber Optic Designs (FOD) has “won” its patent infringement case against Chinese Christmas light manufacturer, Bortex. In granting FOD’s motion for case dispositive sanctions, attributable to discovery abuse by Bortex, the court struck Bortex’s claims that the FOD patent (7,220,022) was invalid, unenforceable and/or not infringed and decided that it would “enter judgment in favor of FOD”. In issuing the opinion, Judge Goldberg pointed out that Bortex’s expert witness had acknowledged that at least claim 69 of the ‘022 patent has been infringed by Bortex. “After years of litigation, we feel as though justice is finally being served,” said David Allen, president of FOD. “This should help us free up some of Fiber Optic Designs’ resources that we intend to use to develop the LED lighting technology that literally started an industry more than 10 years ago. Judge Goldberg pointed out in his opinion that Sean Shao, the owner of Bortex, “lied during his deposition” and “committed perjury.” The court determined that judgment will be entered for patent infringement against Bortex and in favor of FOD. Monetary sanctions for bringing the motion have been awarded in favor of FOD against Bortex and its U.S.A. attorneys, Stamoulis & Weinblatt LLC of Wilmington, DE. The amount of the monetary sanction will be determined in early 2014. The court has not yet ruled on equitable remedies or financial damages to be awarded to FOD attributable to the patent infringement by Bortex. # # #
